Borne House Trust (charity number 21124-1) (the Charity)
The Charity is currently governed by a conveyance dated 20 February 1953 as amended by a scheme in 1958 The Papworth trust is the sole corporate trustee of the Charity.
The conveyance established a charitable trust over a parcel of land known as Borne House and provided for it to be "occupied by aged or infirm persons who shall be or shall have been members of the Nursing Staff of Papworth Village Settlement and in addition for the benefit of the inhabitants of Papworth Village Settlement as the Trustees in their absolute discretion think fit subject nevertheless to and in accordance with the rules and regulations and provision hereinafter contained".
The Charity sold Borne House under a power of sale contained within the conveyance in 2023.
The Charity intends to change its governing document by amending the proceeds of sale clause in the governing document to provide relief to disabled people, including the provision of social housing, in such ways that are for the benefit of the public and are charitable according to English law. This is because in the view of the trustees, the current purposes are not an effective way to achieve the spirit of the charity's original intention, taking into account changes in social and economic circumstances.
